2. Scope and Order of Priority
This Policy applies to payments made directly to Webapps Software Solutions for software development, consulting, websites, applications, marketing and related services. A signed agreement or accepted proposal may provide project-specific cancellation rules. Where it clearly states a different rule, that rule will apply to the extent permitted by law.
The 15-day full-refund benefit applies only to eligible software-project advances. It does not apply to marketing-service payments, advertising budgets or third-party expenses, which are non-refundable as stated below. Third-party products bought directly by the Client are also governed by the relevant provider’s policy.
3. Fifteen-Day No-Questions-Asked Refund
The 15-day period begins on the calendar date an eligible software-project advance is credited to us. A cancellation received before 11:59 PM IST on the fifteenth calendar day qualifies for a refund of 100% of that eligible advance received by Webapps.
No explanation is required. We may ask only for information reasonably necessary to verify the payer, project, transaction and refund destination and to prevent fraud or duplicate payment. This benefit does not cover marketing or advertising payments, or third-party expenses separately approved or incurred for the Client.
By taking the refund, the Client gives up any right to use unfinished concepts, designs, documentation, demonstrations, source code or other project material created before cancellation unless Webapps separately authorises such use in writing.
4. How to Submit a Cancellation
Send a written request to support@webappssoft.com from the registered or authorised email address. Include the Client name, invoice or proposal number, payment date, amount and payment reference.
The request is treated as received when it reaches our designated mailbox. All cancellation, deduction, credit-note and refund communication must be completed over email. Telephone, WhatsApp or other messaging requests will not be treated as a final cancellation request unless confirmed by email, so that both parties have a clear written record.
5. Cancellation After the Fifteen-Day Window
After 15 calendar days, a refund is not automatically guaranteed. We will calculate any eligible amount after deducting:
- 30% of the initial project payment as an onboarding, consultation, planning, administration and resource-allocation charge;
- fees for discovery, design, development, testing, meetings and all other work already performed;
- the value of completed or substantially completed milestones;
- approved expenses and non-recoverable commitments;
- all non-refundable third-party licences and services; and
- applicable taxes, gateway charges or bank costs that cannot be recovered.
The 30% deduction applies in addition to the value of completed work and non-refundable expenses. If total deductions equal or exceed the amount paid, no refund will be due. If the value of work and commitments exceeds payments received, the Client remains responsible for the outstanding amount where the contract permits.
6. Marketing and Advertising Payments
All payments for marketing services are non-refundable. This includes digital marketing, social-media management, search-engine optimisation, paid-advertising management, campaign planning, content marketing, lead generation, branding promotion, email marketing and related consultation or execution.
Advertising media budgets paid to search engines, social networks, marketplaces, publishers or other platforms are also non-refundable once committed, transferred, credited or spent. Pausing or cancelling a campaign does not create a right to refund fees for strategy, setup, creative work, account management, reporting or work already scheduled or performed.
7. Non-Refundable Third-Party Expenses
All third-party expenses purchased, reserved, activated or committed for the Client are non-refundable once incurred, subject to any refund actually provided by that third party. These include:
- servers, cloud infrastructure, hosting, storage and backups;
- domain names, SSL certificates and DNS services;
- Google Play Console, Apple Developer/App Store and other marketplace charges;
- business email, transactional email, SMS, WhatsApp and communication services;
- APIs, plugins, themes, templates, fonts, stock images and media assets;
- software licences, security tools, analytics and monitoring services;
- payment-gateway, advertising-platform and app-review charges; and
- any other external vendor, subscription, government or platform fee.
If the Client expressly instructs or approves an immediate purchase during the 15-day period, that expense will be excluded from any refund to the extent legally permitted. Access or licences will be transferred only where the provider permits, the account is transferable and all related amounts are paid.
7. Client Delay, Inactivity and Abandonment
Failure to provide content, credentials, approvals, feedback or payment may pause the project and extend delivery. We may issue a written inactivity notice. If the Client does not respond within the period stated in that notice, we may close or terminate the project under the applicable agreement.
Client inactivity does not restart or extend the 15-day refund window. Restarting an archived project may require a new schedule and fee.
8. Cancellation by Webapps
We may suspend or cancel for material non-payment, unlawful instructions, abuse, security risk, misrepresentation, repeated failure to cooperate or another material breach, normally after reasonable notice where circumstances permit.
If we cancel without Client breach and cannot provide the contracted service, we will refund the unearned portion of fees after accounting for accepted work and authorised third-party costs. If we cancel during the 15-day full-refund window, the eligible advance will be refunded in full under Section 3.
9. Effect of Cancellation
Work stops after cancellation is confirmed, subject to steps needed to protect systems, data and third parties. Each party must return or protect confidential information as required by any NDA. Ownership of unpaid or refunded work remains with Webapps. Client materials remain the Client’s property.
Webapps may retain invoices, communications and necessary records for legal, tax, security and dispute-resolution purposes. Other data will be handled under the Privacy Policy and applicable agreements.
10. Credit Note, Refund Method and 45-Day Processing Period
After receiving a complete cancellation and refund request by email, Webapps will review the project account and calculate the eligible refund. For cancellations outside the 15-day full-refund window, the 30% initial-payment deduction, value of completed work, completed milestones, approved expenses and all non-refundable third-party costs will be deducted in accordance with this Policy.
Webapps will first issue a credit note showing the original amount received, all applicable deductions and the final approved refundable amount. The credit note and refund confirmation will be communicated to the Client through the registered or authorised email address.
The approved refund will be processed within 45 calendar days after Webapps receives the complete written refund request by email, provided all correct bank, payment and identity-verification details have also been received. If required details are incomplete or incorrect, the 45-day processing period begins when the missing or corrected information is received. This processing period also applies to an eligible refund within the 15-day no-questions-asked window.
Refunds will normally be returned to the original payment method or verified originating bank account. Banking, card or payment-provider settlement may take additional time beyond our control after we initiate the payment.
We will not send a refund to an unrelated third party. Currency-conversion differences, intermediary-bank fees or payment-network deductions may affect the amount credited where legally permitted.
11. Errors, Chargebacks and Disputes
Please contact us before initiating a chargeback so we can review the transaction promptly. A chargeback does not create a right to retain both refunded funds and deliverables. Fraudulent, duplicate or mistaken payments will be investigated and corrected.
This Policy does not restrict non-excludable statutory rights. Indian law governs this Policy, subject to mandatory forums; otherwise competent courts in Kolkata, West Bengal will have jurisdiction.
